This privacy policy informs you about how we, Familie Wiesner Gastronomie AG, (hereinafter referred to as "FWG", "we", "us") obtain and process, pass on, secure and store, destroy or anonymize your personal data (hereinafter also referred to as "data") in connection with the processing activities described below, and whom you can contact if you have any questions. Our processing activities are:

- Your job application and unsolicited job application

- Your job mail subscription

We reserve the right to change this privacy policy at any time and to adapt our processing methods. The current published version, available at https://apply.refline.ch/302831/privacy.html, applies.

We are committed to handling your data responsibly. Consequently, we consider it a matter of course to process your data in accordance with Swiss and, where applicable, applicable European data protection laws.

1. your application and your spontaneous application

When you use the application form, you provide us with your data in accordance with the application form and the application documents you have uploaded for the purpose of filling a position. You ensure that the data you provide is true, correct and up-to-date. Your data will be stored on our application tool of our software partner Refline AG and evaluated, processed and forwarded internally in the context of your application. We inform you that, to the extent permitted by law, we will supplement your profile with data that you have made publicly available from social media profiles such as Xing, LinkedIn, etc., in order to obtain as complete a picture as possible of your professional skills and experience.

The data can also be processed for statistical purposes (e.g. reporting). It is not possible to draw any conclusions about you personally.

In the case of a spontaneous application, we will contact you if we have a suitable position for you.

Underage applicants expressly declare that they will only apply with the consent of their legal guardian.

2. your jobmail subscrition

By subscribing to the job mail, you agree to receive information about job vacancies by e-mail. When you subscribe to the job mail, the data you enter in the input mask will be transmitted to us and stored. The job mail is sent via our software partner Refline AG. The registration for the job mail takes place in the so-called double opt-in procedure. To prevent abuse, we will send you an e-mail after your registration in which we ask you to confirm your registration. In order to be able to prove the registration process according to the legal requirements, the registration is logged. You can revoke your consent to receive a job mail at any time. There is a revocation link at the end of each job mail.

3. retention period

We process your data only as long as it is necessary in the context of our overriding interest or for the fulfillment of our contractual and legal obligations. In the case of employment, your data will be transferred to the personnel dossier; otherwise, in the case of unsuccessful applications, your data will be destroyed or anonymized after 12 months or after revocation of your consent to the job mail. Please note that according to the law, certain data must be kept for a certain period of time. If this is the case, we must and will keep the data for more than 12 months. We will only use it to fulfill legal requirements.

4. disclosure of data to third parties

We will only disclose your data to third parties in the course of our business activities and for the purposes described in this privacy policy if we are required to do so by law, court order or official regulation, if the disclosure is necessary for the assertion, exercise or defense of legal claims or for the performance of contracts and business activities, or on the basis of your consent.

These third parties include our order processors, in particular Refline AG, Baar, as our software partner, as well as IT providers. These service providers are located in Switzerland.

If you use the voluntary option to submit your application or spontaneous application via "One-Click-Option", data from your CV will be automatically read out and filled into pre-structured data fields. The data is read with the help of semantic analysis and artificial intelligence. A service of our partner Textkernel BV (ISO 27001 certified, with headquarters in the Netherlands and server location in the EU) is used. The CV is sent automatically by our software partner Refline AG as an HTTP Post Data Request to the Sourcebox system of Textkernel BV, read by machine, returned automatically and deleted. The use of this option is voluntary and by using it you agree to this kind of processing. The application form can also be filled out manually at any time, so that your data does not leave Switzerland. 

If the level of data protection in a country is deemed inappropriate for Swiss conditions, we will provide appropriate data protection through suitable guarantees, unless there is a legal exception.

5. Data security and confidentiality

We, as well as our contractors, use appropriate technical and organizational measures in the systems to protect your data stored by us against loss, destruction, alteration, and unauthorized access by third parties and to ensure availability. The security measures are continuously adapted in accordance with technological developments. The data is transmitted SSL encrypted. Absolute protection cannot be guaranteed. We also take our own internal data protection very seriously. Our employees and the order processors commissioned by us are obliged to maintain confidentiality and to comply with the provisions of data protection law.

The data you provide us with will be treated confidentially and access to you will only be granted to the extent necessary. In the context of a specific application, only persons involved in filling the position(s) have access to the data you have provided. In particular, our HR department and the supervisor(s) responsible for selection have access to the data you provide. In the case of unsolicited applications, only our HR has prior access. Only when such an application is shortlisted for a specific position will the relevant supervisor be given access to the data you have disclosed.

Unless you inform us otherwise, we reserve the right to accept and review your specific application for other suitable positions.

Only in exceptional cases will employees of our software partner who are called in for support purposes have access to the data you have provided.

HR refers to all employees of the HR management as well as the company management.

Under no circumstances will your data be passed on to other companies or persons or used for other purposes.

6. yout rights to your data

In particular, you have the right to information as well as revocation of your consent in relation to the job mail. Your rights are not absolute. We reserve the right to enforce the restrictions provided for by law.

With a request for information, you can demand information about which data we process about you. For this purpose, we ask you to send us a corresponding identification of your person together with the request. We expressly reserve the right to request further information from you if necessary. Your data entry is on your own responsibility and at your own risk. We exclude our liability to the extent permitted by law. Swiss substantive law applies, excluding the conflict of laws provisions of the Swiss Private International Law (IPRG). The place of jurisdiction is Zurich.
